On Oct. 2, 2008, Mansour Chaalan's vehicle was rear-ended by a vehicle driven by Susan Bell, who was employed by Bell Marine Co. Chaalan filed a lawsuit against Bell and Bell Marine, which had insurance in relation to Bell's car.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that Bell drove her car negligently, and her employer should be held liable because it owned the vehicle. Specifically, he claimed that Bell did not pay attention, drove too fast, drove too close to his car, and failed to stop properly.
DEFENDANTS' CONTENTIONS:
Defendants argued that Chaalan stopped abruptly and absent any warning when the light was green.
Injuries
Plaintiff allegedly suffered bulging disc at C5-6 and L4-5, herniated disc at C4-5, arthroscopy, radiculitis, radiculopathy, torn glenoid labrum, and trigger point injection. He received acupuncture and physical therapy.
Result
The parties settled for $90,000.
