On Dec. 5, 2012, Levan Kukava was driving through an intersection when a vehicle operated by Elspeth Hellerman struck him. The force of the impact threw Kukava's vehicle into another vehicle before it came to rest.
Kukava filed suit against Hellerman, alleging that he was negligent in the operation of the vehicle. He claimed that he had a green light as he entered the intersection and that Hellerman had run a red light.
Hellerman conceded liability.

Defendant contends plaintiff's vehicle sustained over $10,000 in damage while defendant's vehicle required over $11,000 in repairs.

Plaintiff underwent an MRI, which showed disc bulges at L4-5 and foraminal narrowing at L2-3. Plaintiff underwent two steroid epidural injections. Plaintiff alleged he still experiences significant low back pain and neck pain.
