Facts

The defendant was driving tourists through a residential area of Beverly Hills in a mini-coach. The plaintiff, a 52-year-old homemaker, alleged that she passed the defendant on the right and then came to a stop at an intersection, intending to go straight. She contended that the defendant pulled up next to her, and made a right turn into the front left corner of her car. The defendant argued that the accident happened when the plaintiff attempted to pass him, unsafely, on the right while he was turning right at the intersection.
