Facts
Plaintiff Sahil Parikh attended Frank Lanterman School, part of the Los Angeles Unified School District. Plaintiff suffered from encephalopathy, epilepsy, cerebral palsy and seizures.
On Jan. 27, 2005, plaintiff failed to return home after school on the school bus as he routinely did. Plaintiff's mother phoned the school and was told that plaintiff had left the school. Plaintiff's father and sister went to the school around 5:45 p.m. to search for him.
Plaintiff was found in a restroom inside his classroom, leaning against a wall, exhausted and terrified. After paramedics examined him, he returned home. Plaintiffs alleged that after the incident, plaintiff suffered from terrors, an increase in the number and severity of seizures and regressed in his ability to care for himself.
Plaintiff's parents alleged negligent infliction of emotional distress.
Injuries
Post-traumatic stress disorder, seizures, emotional distress, regression in self-care ability.
Result
The parties settled for $74,999.
