Facts

On Nov. 7, 2005, the defendant, Wei Huang, was struck while traveling on the 134 freeway causing his vehicle to spin out. The vehicle driven by decedent, Zhorik Kadimyan, was traveling on the same freeway and was struck by defendant's spinning vehicle. Thirty minutes after the accident, the decedent went into cardiac arrest and died in the ambulance. He was 45 years old. A lawsuit was filed on behalf of the decedents heirs for wrongful death.

Contentions

PLAINTIFFS' CONTENTIONS:
The plaintiffs contended that the decedent's death was caused by the unsafe lane change of the defendant, which caused death by cardiac arrest.

DEFENDANT'S CONTENTIONS:
The defendant contended that his vehicle was hit by another vehicle causing him to spin out. The defendant also contended that the decedent's death was due to pre-existing health conditions. The coroner diagnosed him as dying from natural causes due to constricted artery disease and a prior heart attack in the same area.

Settlement Discussions

There were no prior settlement discussions before the policy limits demand from plaintiff's counsel.

Damages

Claimed damages included loss of services, loss of earnings, loss of love, comfort and support.

Result

The matter settled for the policy limits of $300,000 pursuant to a policy limits demand from plaintiff's counsel.
