PLAINTIFF'S CONTENTIONS:
Plaintiff claimed defendant was driving her sports utility vehicle negligently and cut off plaintiff's 1996 Honda scooter while defendant was making a lane change. Plaintiff claimed this caused him to hit the curb and be ejected from his scooter.
