On Sept. 13, 2012, at approximately 5:04 p.m., plaintiff Pavlin H. Zanev was traveling near the intersection of Sunset Blvd. and Taraval St. in San Francisco, when a no contact accident occurred with defendant Sandra D. Fullerton.

PLAINTIFF'S CONTENTIONS:
Plaintiff claimed defendant was driving her sports utility vehicle negligently and cut off plaintiff's 1996 Honda scooter while defendant was making a lane change. Plaintiff claimed this caused him to hit the curb and be ejected from his scooter.

Plaintiff sought compensatory damages for wage loss, loss of use of property, medical expenses, general damage, property damage, and loss of earning capacity. Plaintiff's wife, Tanya Nacheva-Zanev, claimed loss of consortium for being deprived of her husband's household services, comfort, society, and conjugal companionship.

Injuries

Plaintiff claimed he sustained Schatzker IV tibial plateau fracture with adverse total core recovery.
