On Feb. 7, 2006, Joseph James was driving a 1994 Ford Explorer when it exploded into flames after he struck an object. James died as a result of the explosion.
Contentions
PLAINTIFF'S CONTENTIONS:
Jennifer Hardy, James' wife, and a minor plaintiff, 10 months old, alleged the Explorer was defective and dangerous in design, with defects in the fuel system and its electrical failsafe system, as well as a defective fuel pump shut-off switch.
Damages
Plaintiffs sought damages for funeral and burial expenses.
Injuries
Plaintiffs claimed they suffered emotional distress and James suffered death.
Result
The minor plaintiff settled with Ford Motor Company for $200,000.
