Plaintiff John H. Feiner, an experienced attorney, bought a 2009 Infiniti FX50 from defendant Glendale Infiniti, an auto dealership. Plaintiff presented a down payment check on his business account for $26,800, stopped payment on the check and kept the car.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that he was defrauded by a misrepresentation of the model of the vehicle.

DEFENDANT'S CONTENTIONS:
Defendant contended that Plaintiff signed 13 documents with the correct model of the car; and that Plaintiff never had sufficient funds to cover the down payment check.

Result

Plaintiff paid $20,000 for damages and legal fees. The Court ordered the vehicle returned to Glendale Infiniti.
