Facts

On Aug. 5, 2011, Plaintiffs' 7-year-old son, Jeremy Perez, died when a big rig truck ran him over as Jeremy rode his bicycle in a supermarket parking lot. While reversing without a spotter, the truck knocked Jeremy from his bicycle and ran over his head and chest. At the time of the accident, the driver of Defendant Sara Lee Bakery commercial truck had parked his vehicle adjacent to the pedestrian walkway in such a manner as to block the field of vision of both the big rig truck driver and Jeremy.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiffs alleged that Defendant was partially liable for Jeremy's death based on how the defendant driver had parked the Sara Lee Bakery commercial truck.

Result

The case settled for $100,000.

Other Information

Plaintiffs had previously resolved a lawsuit against the main tortfeasor on terms acceptable to all parties.
