Facts
Mildred Greenberg was stopped at an intersection, waiting to turn right, when she was rear-ended by a vehicle operated by Lynne Mayer. She suffered injuries as a result thereof and sued Meyer for negligence.
Damages
Greenberg sought $63,020 in past medical costs and an unspecified amount of damages for pain and suffering.
Injuries
Greenberg went to an urgent care that evening with pain to her right, dominant arm and shoulder. She was diagnosed with a strained shoulder, which she followed up with several months pf physical therapy. An MRI later revealed a partial tear on her tendon by her rotator cuff. She could not undergo surgery until later due to other medical issues. She continued to experience ongoing pain on her right arm.
Result
The jury found Mayer 100 percent at fault and awarded Greenberg $3,458 in damages for her past medical costs only.
