Facts

Linda Gonzalez was visiting Goofy's Kitchen in Disneyland when she slipped and fell on a wet surface, causing her face to strike a guardrail. She sued Walt Disney Parts and Resorts U.S. and The Walt Disney Co. for premises liability.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that Defendants failed to properly and timely address the wet surface created by water spilling, creating a dangerous condition.

DEFENDANTS' CONTENTIONS:
Defendants contended that Plaintiff must have tripped over her shoe, causing her face to hit the guardrail. Defendants also noted the contradicting evidence.

Damages

Gonzalez sought $15,000 in past medical costs; $9,000 for past lost earnings; and $25,000 for past pain and suffering.

Injuries

Gonzalez broke her nose and underwent a reconstructive rhinoplasty three months following the accident. She also claimed minor bruises to her back and knees, which she treated with physical therapy. She missed several weeks of work and could not perform her duties as the director of the Miss Artesia Pageant for one year after the accident.

Result

The jury rendered a unanimous defense verdict.
