Facts

California district attorneys filed an unfair competition lawsuit against Fidelity National Financial Inc., regarding Fidelity's "Transaction Point" real estate software system. The district attorneys alleged that the software platform, which Fidelity operated for real estate brokers and other settlement service providers in California, facilitated unlawful secret payments to the brokers for the referral of business to title insurers and other service providers.

Result

The parties agreed to stipulate final judgment enjoining Fidelity from operating any such real estate software system and requiring that Fidelity pay a total of $873,588 in civil penalties and agency costs.
