Facts

On April 10, 2012 plaintiff, a pedestrian, was struck and injured by a truck driven by Keith Gordon, an employee of the City of Los Angeles. The collision occurred on Los Angeles Street between Temple and First Streets, in the City of Los Angeles. Plaintiff sued Gordon and the city, asserting a claim for motor vehicle negligence.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that Gordon negligently operated his vehicle and that the city was vicariously liable.

DEFENDANT'S CONTENTIONS:
Gordon denied plaintiff's allegations.

Result

Plaintiff settled with the city for $125,000, and recovered $350,000 from defendant's personal Allstate insurance.
