Plaintiff

Marina Fraigun

Defendant

Laura W. Shelby
(Seyfarth Shaw LLP)

Facts

Plaintiff Combos worked for Pratt & Whitney Rocketdyne Inc., and was on medical leave for five years. He sought to return to work, but after an extended interactive process, Pratt terminated his employment. He then filed suit.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff alleged disability discrimination and failure to accommodate.

DEFENDANT'S CONTENTIONS:
Defendant contended that it engaged in the interactive process for over a year and a half to determine whether plaintiff could perform essential work functions of his former position or other open position. Defendant claimed that several doctors opined that plaintiff could not do so, which lead to the termination.

Result

The court granted defendant summary judgment, finding that plaintiff failed to provide sufficient evidence and medical support to prove the claims.
