Facts

The Los Angeles Times reported on the marketing campaign by "1-800-Get-Thin," which promoted the Lap-Band surgery, a weight loss procedure. Michael Hiltzik wrote the articles as a columnist for the Los Angeles Times. 1 800 GET THIN LLC, the company that advertised the phone number, filed suit against Los Angeles Times Communications, alleging federal Latham Act claims.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that Hiltzik authored four negative columns about plaintiff, which damaged plaintiff's business. Plaintiff claimed that Hiltzik was engaged in a personal vendetta to bring financial harm to plaintiff, and that the Los Angeles Times failed to take action in response to the allegations.

Result

The court granted defendant's motion to dismiss the case in its entirety with prejudice.
