Carol Drake filed a complaint against the Acting Commissioner of Social Security Administration, Carolyn Colvin, seeking judicial review of the denial of her application for disability benefits.
Contentions
PLAINTIFF'S CONTENTIONS:
Defendant allegedly wrongfully denied plaintiff's application for Social Security Disability Insurance benefits despite her disability. Plaintiff allegedly suffered from hyperthyroidism and chronic fatigue syndrome. In denying her application, the administrative law judge determined that her impairments were not severe and that she was able to do work. Plaintiff maintained that her medically determinable impairments prevented her from working. Plaintiff filed this lawsuit and moved for summary judgment.
DEFENDANT'S CONTENTIONS:
Defendant denied plaintiff suffered from any disability. Defendant filed a cross-motion for summary judgment.
Result
The district court found the ALJ's determination was not supported by substantial evidence, and therefore remanded the matter for further proceedings.
