Plaintiffs Jose Monzon, Anagivio Aguilar, Karla Artiga, and minors Jayce Artiga, Dylan DeSantos, and Dahvi DeSantos, along with, Jaime Fabian, Adriana Gonzalez, and minors Norberto Fabian, and Jaime Fabian Jr., and, Denise Lopez, and Kenneth Rivas, sued Florence Waterman, as Trustee of the Florence S. Waterman Trust Dated Dec. 3, 2004, F1425 LLC, in connection with the residence they inhabited.

Contentions

PLAINTIFFS' CONTENTIONS:
Plaintiffs lived in an allegedly uninhabitable property owned and operated by defendant. Among other things, plaintiffs claimed that the property was infested with rodents, insects, and/or vermin. Plaintiffs also claimed that the property was not equipped with safety equipment such as working smoke detectors and that the property was generally ill maintained. Plaintiffs suffered injuries as a result and sued defendants for breach of implied warranty of habitability, breach of statutory warranty of habitability, breach of the covenant of quiet enjoyment, negligence, violation of Civil Code Section 1942.4, and unlawful entry.

DEFENDANT'S CONTENTIONS:
Defendants denied the allegations and asserted various affirmative defenses.

Result

The parties reached a $125,000 in total settlement.
