Defendant

Marc A. Kohm

Facts

Petitioner was a state prisoner serving 131 years-to-life for first degree murder and possession of a firearm by a felon. He brought a petition for writ of habeas corpus in federal court pursuant to 28 U.S.C. 2254.

Contentions

PETITIONER'S CONTENTIONS:
Petitioner contended that there was insufficient evidence linking him to the fatal shooting, irrelevant evidence was admitted depriving him of due process and a fair trial, the trial court erred when it instructed the jury on accomplice liability, and there was insufficient evidence petitioner was holding a firearm.

RESPONDENT'S CONTENTIONS:
Respondent contended that petitioner's claims were barred because they all had been reasonably rejected on the merits by a state court.

Result

The court dismissed petitioner's petition with prejudice.
