Plaintiff worked as a sales estimator for defendant, a provider of insulation products and services for commercial and residential buildings. He filed an employment action against defendant following his termination, asserting 17 causes of action.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff contended that he suffered from stress, anxiety, depression, back pain, right shoulder condition, right hand condition, gastritis, and other conditions and that defendant failed to engage in the interactive process to determine reasonable accommodations. Furthermore, plaintiff contended that he harassed by his supervisor, who called him vulgar, degrading names. Ultimately, defendant wrongfully terminated plaintiff. Furthermore, he claimed that defendants committed various Labor Code violations.
DEFENDANT'S CONTENTIONS:
Viking Insulation denied plaintiff's allegations and asserted that plaintiff was the harasser. Furthermore, plaintiff was not wrongfully terminated. Rather, plaintiff abandoned his employment.
Result
The jury returned a defense verdict.
