Facts

Clean Water Fund, Center for Environmental Health, and the Association of Irritated Residents sued the Valley Water Management Co., involving Proposition 65.

Contentions

PLAINTIFFS' CONTENTIONS:
Defendant allegedly violated Prop. 65 by dumping toxic chemicals, including, inter alia, benzene, toluene, and other chemicals, into the ground, contaminating nearby aquifers.

Result

The parties reached a settlement providing both monetary and injunctive relief. As part of the settlement, Valley Water agreed to pay $198,470 in total settlement including $80,000 in civil penalties and, among other things, agreed to conduct certain monitoring and pilot testing.
