Facts
A class of California men who were not offered free air travel during defendant Club Med's 2003 promotion "Ladies Fly Free" brought a class action suit. Plaintiffs alleged that defendant held a promotion in 2003 for travel to Cancun and Turks & Caicos resorts and provided female consumers with free airfare while not offering male consumers the same free air travel.
Plaintiffs brought suit under the Unruh Civil Rights and Gender Tax Repeal Acts.
Result
Orange County Superior Court Judge Ronald H. Bauer approved a settlement whereby each class member who made a claim will receive a cash payment of $1,250, minus costs, as well as $1,200 in vouchers for travel to several Club Med resorts. Attorney fees of $400,000 and costs of $23,232.12 were also paid. Defendant also agreed not to hold any promotions that would discriminate against consumers based on gender.
