Facts

Plaintiff Eric Jay Ward, an attorney, alleged that during his temporary engagement as acting general counsel at Future US Inc., he opposed sexually inappropriate material in the workplace. Plaintiff alleged that as a result, Future US retaliated against him by discontinuing the process of hiring him as its permanent general counsel.

Future US denied that it retaliated against plaintiff, and asserted that it did not hire him because plaintiff was more interested in working as a business development person than a lawyer.
