Facts

On Nov. 7, 2003, plaintiff Terrance Klein was riding his motorcycle on a street in front of defendant, Christina Navratil's home. The defendant owned a large dog and allowed it to run around unleashed near her house. On this occasion, the dog ran into the street and struck plaintiff's motorcycle, causing plaintiff to fall and suffer injury.

Contentions

PLAINTIFF'S CONTENTIONS:
The plaintiff alleged defendant was negligent and knew or should have known that loose, unleashed dogs were a hazard to a motor vehicle.

Settlement Discussions

Defendant and plaintiff stipulated that defendant was 100 percent at fault for plaintiff's injuries and that plaintiff's medical bills were $22,841 and were reasonable and necessary.
