Facts

The plaintiff attended a private party during which two other men beat him up. The plaintiff contended that the men who beat him up were uninvited guests and should not have been allowed into the party. The party's hosts had hired defendant Executive Solutions to provide security for the party including keeping out uninvited guests. When the assailants arrived at the party, the Executive Solutions guards allowed the men, who were not on the guest list, to cut ahead of the check-in line and go into the party. The assailants were acquaintances of the guards. After the attack, the guards helped the assailants leave the premises before the police arrived.

Contentions

CONTENTIONS:
The defendant contended that the alleged assailants were guests of an invited guest, and therefore, authorized to be at the party. Executive Solutions also contended that the guards conducted themselves professionally in all other respects.

Injuries

The plaintiff received cuts, contusions and soft tissue injuries to his face and body. Additionally, the plaintiff was recuperating from his injuries and was unable to participate in a real estate deal and claimed a loss of earnings from that deal of approximately $250,000.

Result

The case settled for $85,000 at the mandatory settlement conference five days before trial.

Other Information

The homeowner who hosted the party was also a defendant but was dismissed on summary judgment.
