In October 2003, plaintiff Travis Koh was driving in Los Angeles. Defendant William Cornick was driving behind him. Defendant Marc Cena was driving behind defendant Cornick and rear-ended him. As a result, defendant Cornick's vehicle collided with the plaintiff's stopped vehicle.

The plaintiff sued, claiming negligence. The plaintiff reached a $500 settlement with defendant Cornick.

Defendant Cena admitted liability.
