Roselle Metry, a minor, by and through her Guardian ad Litem, and Adel Metry and Reem Tawfik, individually sued Party Planners Plus, in connection with Roselle's injuries.
Contentions
PLAINTIFFS' CONTENTIONS:
Plaintiffs alleged that on May 19, 2103, Roselle, who was then two, was jumping on a bouncer provided at a party in a private home when the bouncer suddenly, and without warning, came free from its tether, causing the bouncer to fly into the air, taking Roselle with it. The bouncer then crashed, causing injuries to Roselle. Plaintiffs alleged that defendant, who owned and operated the bouncer, was liable for Roselle's injuries. As such, plaintiffs sued defendant and asserted causes of action for negligence, strict products liability, and negligent infliction of emotional distress.
DEFENDANT'S CONTENTIONS:
Defendant denied plaintiffs' allegations, and asserted various affirmative defenses.
Result
The parties agreed to a $170,000 settlement on Roselle's claims and $20,000 for her parent's on their negligent infliction of emotional distress claim.
