Facts

Crystal Antonelli, Anny Chi, Alisha Elam, Analynn Foronda, and Karen Lopez sued their former employer, Finish Line Inc., and former manager, David Meyer, concerning Meyer's alleged wrongdoings.

Contentions

PLAINTIFFS' CONTENTIONS:
Plaintiffs alleged that they were former employees of defendant Finish Line's store located at the Great Mall in Milpitas, and that defendant Meyer was their store manager. Plaintiffs accused Meyer of placing a concealed camera in the employee's restroom and general dressing room for the purposes of recording. Plaintiffs alleged that they were recorded, without their knowledge or consent, while using the dressing room and restroom. Plaintiff further alleged that the recordings caught them in compromising situations and states of undress.

Damages

Plaintiffs sought damages for past and future emotional distress, past and future economic damages, treble damages, and attorney fees and costs.

Result

The matter proceeded to arbitration against Finish Line. Ultimately, that resulted in an award in favor of Finish Line on all causes of action. Accordingly, judgment was entered in favor of Finish Line on June 21, 2013. Next, plaintiffs moved for summary judgment on their claims against Meyer, which the court granted in part, and denied in part. Then, the court awarded each plaintiff damages accordingly. The court awarded Antonelli $341,598, Chi $370,964, Elam $354,952, Foronda $315,197, and Lopez $369,365 each in total damages against Meyer only. The court granted plaintiffs' request for interest at the rate of 7 percent per annum, but denied plaintiffs' request for treble damages. It also denied plaintiffs' request for attorney fees and costs.
