Facts

Francesco La Manna sued Farshid Yassian also known as Fred Yassian and Jacob Khorsandi, concerning a contract dispute. Yassian filed a cross-complaint against La Manna.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff filed this lawsuit after Yassian failed to make each, scheduled installment payment pursuant to a $155,000 promissory note for the sale of his interest in a company known as Brunello Ristorante LLC. The company operated a restaurant known as Prego in Beverly Hills.

Plaintiff asserted a cause of action for breach of contract against Yassian and a breach of contract (guarantee) against Khorsandi.

DEFENDANTS' CONTENTIONS:
Defendants Yassian filed a cross-complaint against La Manna alleging that he was defrauded into the transaction.

Result

On June 13, 2014, the jury found in La Manna's favor and awarded him $250,000 on his breach of contract claim against Yassian, but nothing on the breach of contract claim against Khorsandi. After Yassian filed a motion for a new trial based on excessive damages, the court reduced the judgment to correct the interest rate calculations awarding $227,333 (the amount of the note for $155,000 plus $72,333 in interest). On On Sept. 10, 2014, the court awarded additional $5,927 in cost and on Oct. 1, 2014 the court awarded $77,931 in attorney fees. On Sept. 15, 2014, the court entered judgment in favor of La Manna, and against Yassian in the amount of $155,000, plus $72,333 in interest, for at total of $227,333. The court also entered a judgment in favor of La Manna on Yassian's cross-complaint.
