Facts

On Aug. 12, 1992, plaintiff Ann Slobko, then 75 years old, underwent arthroplasty surgery on her left hip performed by defendant Dr. Richard Evans, a board certified orthopedic surgeon and employee of defendant Cherry Creek Orthopedic Surgery. Plaintiff was informed that the surgery was necessary to revise a femoral stem from a previous surgery (plaintiff had three prior surgeries). Plaintiff claimed the surgery failed, causing her severe pain and left her crippled and incapacitated. The plaintiff brought this action against defendants Evans and Cherry Creek, based on negligence and medical malpractice theories of recovery.

Settlement Discussions

The plaintiff did not make a settlement demand. The defendant made a $1.00 statutory offer of settlement.

$150,000 (past and future nursing home care and related expenses); $750,000 (past and future non-economic losses)

Injuries

The plaintiff claimed to suffer an intraoperative fracture during surgery which went into a nonunion and caused her to be severely incapacitated. Plaintiff also claimed she would require nursing home care due to her incapacity.
