Facts
The plaintiff contended that the 2,200 unit residential master community located in Laguna Niguel was plaged by the following construction defects: slope creep, cracks and separations in terrace drains and down drains, tilted, cracked and stained retaining walls, separation of sideyard wall/pilaster connections, cracked concrete flatwork and asphalt pavement, soil erosion in graded and natural areas and backyard distress. The defendants disputed the plaintiffÆs cost of repair estimate for the alleged defective conditions and alleged as affirmative defenses that several defects were outside the applicable statute of limitations. The defendants further contended that the plaintiff association failed to properly maintain the common areas of the development.
