Facts
On Monday, Nov. 28, 2005, at 9:33 a.m., plaintiff was driving her 2005 VW Jetta eastbound on Sunset Boulevard in Los Angeles in the number two lane. As she approached the intersection with Hillcrest Road in Beverly Hills, she brought her vehicle to a controlled stop for a red traffic signal. After several seconds, her VW was struck from the rear without warning by a 2003 Toyota Tacoma owned and operated by defendant.
Contentions
PLAINTIFF'S CONTENTIONS:
Defendant violated Vehicle Code Section 21703 (following too closely). The trauma exacerbated her pre-existing assymptomatic gastrointestinal condition. Plaintiff contended negligence and negligence per se.
DEFENDANT'S CONTENTIONS:
Contested the nature and extent of her injuries.
Injuries
Plaintiff was transported by ambulance to Cedar-Sinai Medical Center for emergency treatment. She was discharged an hour later but returned to the emergency room on Dec. 7, 2005 with complaints of dehydration and weight loss. Test were negative and she was again discharged. The next day, Dr. Gary Hoffman admitted her to Century City Doctors Hospital with severe diarrhea. She was discharged six days later.
Result
Settlement, $275,000.
