Facts

On March 16, 2006, Carol Austin, age 54, was driving her 1999 Toyota Camry on the 405 freeway going northbound. Doe defendant driver drove behind Austin in a Ford/CTL/9000 three-axle truck and trailer. Austin slowed her vehicle to stop due to traffic ahead and Doe collided with Austin. Doe drove in the scope of his employment with Contrast Lighting Services Inc.

Austin sued Doe and Contrast Lighting Services Inc. for motor vehicle negligence.

Settlement Discussions

The defense offered $125,000 during the first mediation on Nov. 9, 2008. At the second mediation session, the initial demand was $2.4 million. The parties settled for $640,000.

Injuries

The plaintiff suffered neck, back, knee, elbow, wrist, and hip injuries. She also sustained a ruptures disc at the C4-C5 level and required cervical injections, interbody fusion, and cervical discectomy.

Result

The parties settled for $640,000 at the second mediation before Janet Fields, Esq.

Other Information

Firemans Fund insured the defendants.
