Facts

On May 20, 2006, plaintiff Michael Salas, age 6 years old, was injured while playing soccer at Chet Holified Park in defendant City of Montebello. Salas' right eye was punctured when he fell on a damaged chain link fence. Defendant Alicia Morgutia was the owner of an apartment complex located next to the park.

Salas filed suit for negligence on January 16, 2007.

Contentions

PLAINTIFF'S CONTENTIONS:
Salas contended that the defendants failed to properly maintain the fence, which caused his injury.

Injuries

Salas suffered a puncture to his right eye and face lacerations.

Result

Salas accepted a settlement in the amount of $10,000 from Morgutia and $2,500 from City of Montebello.
