Facts

Lifescan Inc. and Johnson & Johnson sought a preliminary injunction against Shasta Technologies LLC, Decision Diagnostics Corp., Pharmatech Solutions Inc. and Conductive Technologies Inc. for violations of the Lanham Act and related state laws. The injunction sought to bar defendants from using plaintiffs' logos and trade dress on the packaging and advertisements for defendants' competing product. Both parties manufactured and sold meters and test trips used by persons with diabetes to monitor the blood glucose levels.

Result

U.S. District Court Judge Jon S. Tigar granted plaintiffs' motion for a preliminary injunction, enjoining defendants from shipping to customers products containing plaintiffs' logos and trade dress.
