Facts

On Aug. 5, 2010, plaintiff Ameneh Zeynalzagedan was driving when she was struck in the rear by a vehicle operated by Jamison Data. Zeynalzagedan sued Data, arguing that Data was negligent in the operation of her vehicle. Zeynalzagedan claimed that she was nearly stopped when her vehicle was suddenly rear-ended. An investigating California Highway Patrol Officer charged Data with a violation of the California Vehicle Code for excessive and unsafe speed during the prevailing conditions.

Data admitted to traveling at a high speed and diverting his attention to change radio channels at the time of the accident.

Damages

Zeynalzagedan claimed $90,000 in medical costs, $40,334 in lost earnings, and general damages in excess of $500,000.

Injuries

Zeynalzagedan was diagnosed with cervical disc herniations and a supraspinatus tear. She underwent an anterior cervical decompression and fusion and a left shoulder arthroscopy.

Result

The parties settled for $800,000.
