Published: Jun. 6, 2013 | Result Date: May 26, 2013 |

Case number: BC491633 Demurrer –  Defense with leave to amend

Court

L.A. Superior Central

Attorneys

Plaintiff

Byron T. Ball

Defendant

Kevin H. Brogan
(Hill, Farrer & Burrill LLP)

Facts

Stephen Baldwin and Spyridon Contogouris filed a malpractice lawsuit against Jeffer Mangels Butler & Mitchell and Daniel Grigsby, seeking $10 million in damages. Baldwin claimed that the firm represented him, while also helping Kevin Costner buy him out of their oil cleanup company, thereby cutting him out of a $52 million deal with oil giant, BP PLC.

Result

Los Angeles Superior Court Judge Mary Ann Murphy sustained the defendants' demurrer to the first amended complaint with leave to amend. Judge Murphy did not find sufficient facts showing an attorney-client relationship between Baldwin and the defendants. The matter was therefore dismissed.
