Facts

Erma Glover resided at the Villa Valencia of Redlands, a townhouse community. At approximately 7:30 on the night of Sept. 13, 2011, she went to the trash enclosure in the common area and stumbled over a single riser. She sustained an injury to her left arm as a result thereof and sued Villa Valencia of Redlands Homeowners Association, Stratus Development Partners LLC, Oxbow Communities Inc., SBI Buildings Inc., and RedlandsCA77 LLC for negligence.

Stratus and Oxbow were voluntarily dismissed from the case prior to trial. Glover subsequently settled with SBI Buildings and RedlandsCA77 for $40,000. Thus, the matter continued against Villa Valencia only.

Damages

Glover sought $104,000 in past medical costs and $425,000 for her pain and suffering.

Injuries

Glover was taken by ambulance to the emergency room where she was hospitalized for three days. She fractured her left, non-dominant humerus, and underwent surgery followed up with one month of rehabilitation. She continued to suffer from residual pain and weakness in her left arm, affecting her ability to lift items and perform daily grooming.

Result

The jury found Villa Valencia negligent, but that its negligence was not a substantial factor in causing Glover harm. Hence, no damages were awarded to Glover.
