PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that on Oct. 24, 2011, he stopped at an intersection behind another car. He alleged defendant De La Rosa crashed into the back of his car while driving very quickly and caused plaintiff's vehicle to crash into another vehicle in front of him. Plaintiff argued that De La Rosa negligently drove and his employer, Thomas Rose, and the owner of his car, Berry Rose, should be liable as well. Plaintiff argued that defendant De La Rosa was driving for his employer when the accident occurred,
DEFENDANT'S CONTENTIONS:
Defendant argued that plaintiff received unnecessary medical care, and that he was not entitled to the excessive amount of damages he sought.
Settlement Discussions
Plaintiff demanded $600,000 and defendants offered $175,000.
Damages
Plaintiff sought $4 million, which included past medical costs of $184,249.25.
Injuries
Plaintiff claimed he suffered abrasions, annular tear, back injury, neck injury, lumbar disc protrusion, herniated discs, lumbar laminectomy, microdiscecteomy, numbness, radicular pain, shoulder pain, thumb injury and wrist injury. He received epidural injections, facetectomy, and physical therapy.
Result
The jury awarded Snegg $1,803,170.
