Sedik Sevanesian sued U.S. Bank Trust National Association in connection with a fall that allegedly occurred while she was visiting a house for sale.

Contentions

PLAINTIFF'S CONTENTIONS: On Nov. 18, 2012, plaintiff visited a home for sale that was being sold by defendant Bank and others to plaintiff's daughter. Plaintiff fell on a marble step as she entered the living room. Plaintiff sued defendant and others, including REMAX Master Realty and the selling agent, alleging causes of action for negligence and premises liability.

DEFENDANT'S CONTENTIONS: REMAX and the selling agent denied any involvement in the design or installation where plaintiff allegedly fell. REMAX moved for summary judgment.

Result

The court granted summary judgment in favor of the agent and Remax.
