PLAINTIFF’S CONTENTIONS: Duarte contended that his apartment was flooded after a water boiler exploded. Duarte further alleged that he tripped and injured his elbow as he tried to exit the apartment.

DEFENDANTS' CONTENTIONS: The defendants moved for summary judgment, arguing that plaintiff admitted to, and the court had admitted, an RFA that nullified liability on defendants part.

Summary judgment was granted.
