Facts
Plaintiff sued defendants relating to a real estate venture, asserting in its first amended complaint a sole cause of action against VDC at the Met LLC, for negligent interference with prospective economic advantage.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that it entered into a written contract to represent defendants in a real estate development project, which would entitle it to 40 percent of the profits derived from the property in question. VDC, which was formed for the purpose of developing the property, wrongfully rejected an option to extend a deadline for certain goals, disrupting plaintiff's relationship in the project and cheating it out of its share of the profits.
DEFENDANT'S CONTENTIONS: VDC contended in its demurrer that plaintiff's allegations were conclusory.
Result
The court sustained the demurrer.
