Maria Sandoval, an independent contractor, entered into an agreement with Total Distribution Services Inc. Under the agreement's terms, Total Distribution was not liable for any losses or injuries arising out of acts of negligence or misconduct. After Ramiro Sandoval was injured, Maria and Ramiro sued Total Distribution.

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that Ramiro was injured after a Total Distribution employee negligently struck him with a vehicle.
