Facts
Christina Caballero filed a lawsuit against Laura Ebersole in relation to a rear-end automotive collision occurring on Interstate 405 in Seal Beach.
Contentions
PLAINTIFF'S CONTENTIONS: Caballero contended that Ebersole was the cause of the collision as she was negligent in the operation of her vehicle. Caballero also contended that the registered owner of the vehicle was vicariously liable. Caballero argued that Ebersole was driving while intoxicated and her impairment caused her to strike Caballero, who had come to a complete stop. Caballero further argued that Ebersole attempted to flee the scene and was subsequently arrested for driving under the influence.
DEFENDANT'S CONTENTIONS: Ebersole denied the allegations.
Settlement Discussions
In response to Caballero's demand offer, Ebersole offered $37,000 to settle the case, which was denied. The policy limits were opened and the case proceeded on an open-policy basis.
Damages
Caballero made a demand for the policy limit of $100,000.
Injuries
Caballero suffered a bulging cervical disc, damage to her arm, and whiplash. Caballero's injuries required spinal surgery and a subsequent spinal fusion surgery. Caballero also underwent epidural injections and physical therapy.
Result
The case settled for $500,000.
