Plaintiff Canyon Vineyard Estates sought an amendment to the City of Malibu's local coastal Program to change the zoning designation of the subject property from public open space to rural residential, which would allow for development of the property.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that quiet title and declaratory relief should be granted as to defendant's right to restrict development at the property.

DEFENDANT'S CONTENTIONS: Defendant contended that the amendment should be denied, opining that the restrictions on development set forth in the grant deed may apply to the property despite the subordination agreement.

Result

The court granted the City of Malibu's motion for judgment on the pleadings.
