Plaintiff Polaris Powered Technologies filed suit against Vizio Inc. in relation the Method and Apparatus to Drive LED Arrays using Time Sharing Technique.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant directly infringed the patent of arranging and controlling light sources that was a significant advance in improving display quality in electronics products such as televisions. Additionally, plaintiff contended that as a result of defendant's infringement, plaintiff has suffered monetary damages and is entitled to no less than a reasonable royalty for defendants use of the claimed inventions of the patent. Further, plaintiff contended that defendant directly infringed on a manner of detecting faults in an LED based system.
DEFENDANT'S CONTENTIONS: Defendant filed a motion to dismiss the claims for infringement for failure to state a claim upon which relief can be granted. Additionally, defendant alleged that plaintiff did not provide notice of infringement to defendant.
Result
The court granted defendant's motion to dismiss on all claims.
