Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant gained a license to label products with the "Black and Decker" brand. Plaintiff contended that defendant did not prominently and reasonably convey to consumers that the items were manufactured and warrantied by defendant, rather than Black and Decker. Plaintiff contended that this omission constituted deceptive trade practices, fraud, and breach of express warranty.
DEFENDANT'S CONTENTIONS: Defendant contended that its labeling was sufficient and non-deceptive.
Result
The parties reached a settlement. Spectrum agreed to pay the plaintiff class $2,250,000.
