Facts

On Oct. 20, 2018, at 10 a.m., plaintiff Robert Turoff, 83, tripped and fell as a result of an uplifted sidewalk on Commodore Sloat Drive, in Los Angeles. The uplift had existed for several years and had been painted with "Caution! Watch Out!"

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendants Douglas Emmett 2015 LLC and City of Los Angeles negligently failed to maintain the property.

DEFENDANT'S CONTENTIONS: Defendants contended that the uplifted sidewalk was open and obvious.
