Facts

Plaintiff Thomas Luca Jr. filed suit against Wyndham Hotel Group LLC and Wyndham Hotels & Resorts LLC, that involved alleged deceptive resort fees hotel guests were subjected to when booking through the Wyndham website.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended he and other consumers were charged deceptive resort fees because those resort fees did not cover any amenities or services. Plaintiff contended the fees were arbitrary amounts that the hotel deducted from room rate prices, which allowed the hotel operator to advertise the nightly room rate lower than it actually was at his discretion.

DEFENDANT'S CONTENTIONS: Defendant denied the contentions.

Result

The parties agreed to a settlement and under the agreement, Wyndham agreed to pay $6 million. Further consumers could collect a cash payment of $22 or 2,200 Wyndham Rewards Points.
