Facts
Plaintiff John Doe was working as an electrician at a construction site 25 feet off the ground. Plaintiff was required to work from a beam because his employer failed to place temporary plywood to walk on. Plaintiff fell from the beam and filed suit as a result.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that his fall from the beam caused him significant and serious injuries, including but not limited to, numerous fractures and a traumatic brain injury.
DEFENDANT'S CONTENTIONS: Defendant denied the contentions. Defendant alleged privette barred any recovery to plaintiff.
