Facts

On Dec. 4, 2015, at approximately 12:45 p.m., defendant was opening the door of his Nissan Altima when plaintiff struck the interior of the door with his bicycle and fell to the ground. Defendant was parked in a designated space with his driver door open at the time.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant was at fault because he violated Vehicle Code Section 22517.

DEFENDANT'S CONTENTIONS: Defendant, an Environmental Health Specialist, contended that he did not see plaintiff when he checked his rear view mirror before opening the door. Defendant contended that the area was primarily residential with no nearby driveways where plaintiff could have suddenly appeared.

Injuries

Plaintiff suffered an abrasion to and pain in his right hand.

Result

The parties entered a $195,000 settlement.
